Copyright, Hadlang o Tulong sa Pagiging Malikhain?


“Dapat barilin sa ulo ang copyright.”

Ito ang mariing pahayag ng tagapagsalita sa isang forum na dinaluhan ko kamakailan. Ayon sa tagapagsalita, na guro sa isang pamantasan sa Maynila, ang copyright ay hadlang sa pagdami ng mga bagong likha kaya dapat lamang na tuluyan na itong isantabi at kitlin ang buhay.

Ikaw, ano sa palagay mo? Hadlang nga ba ang copyright sa creativity o pagiging malikhain o tulong sa paglabas ng mga bagong likha?

Mataas ang tingin sa mga malikhaing tao mula noon hanggang ngayon. Makikita at mararanasan ang creative output nila sa mga tula, awit, nobela, drowing, at eskultura. Dahil naiaangat ng likha ang isip at damdamin, itinuturing na genius ang mga malikhaing tao. Angat kasi sila sa pangkaraniwan.

Halimbawa, ang literotika o nobelang erotika ni Frida Mujer na “Mingaw” ay matatawag na likhang angat sa pangkaraniwan. Sa pamamagitan ng maiinit na sex scenes ay naipahayag ni Mujer ang kalagayan ng mga OFW. Maiinit ang aksiyon sa kama para malabanan ang lamig sa puso dahil sa pagkalayo sa sariling bayan at pamilya.

Nakuha natin ang salitang muse mula sa mga sinaunang Greek. Ang musa ay diyosa na nagbibigay-inspirasyon sa mga malikhaing tao. Kadalasan, ang creative output ay likha sa literatura at sining. Ang pinuno ng mga musa ay si Apollo na isa sa mga diyos sa Mt. Olympus. Ayon sa mga eskultura at painting, si Apollo ay laging may hawak na lira. Ang musa ang siyang nag-uudyok sa may hawak ng lira na lumikha ng musika.

Mula sa salitang musa ang salitang musika. Ang ibig sabihin ng musika ay ang sining ng mga musa. Mula rin sa salitang musa ang museum. Ang ibig sabihin naman nito ay lugar ng musa.

Nagpatugtog kaya si Mujer ng lira? Nakinig kaya siya sa musika? Bumisita kaya siya sa museum kaya’t na-inspire ng mga musa para maisulat ang “Mingaw?”

Ang copyright ay isang legal protection na ibinibigay sa mga awtor ng likhang scientific, literary, at artistic. Ibig sabihin ang awtor lamang ang may exclusive right o solong karapatan para magbigay-permiso sa sinumang nais gumamit o magparami ng kanyang akda.

Si Mujer lamang ang may kapangyarihang bigyang-permiso ang publisher na ilathala ang kanyang libro. Ang tanong: bakit nakalikha pa rin siya ng “Mingaw” kung hadlang ang copyright sa creativity?

Ang binibigyan ng copyright ay ang expression of ideas, hindi ang ideas o facts lamang. Ibig sabihin ang ideas tulad ng OFW, Korea, sex, love, college student, at iba pa ay puwedeng gamitin ng kahit na sinong awtor sa kanyang nobela o tula. Pero ang may copyright ay ang expression nito o kung papaano ito naisulat at nabigyang-buhay. Tulad na lang ng “Mingaw” ni Mujer.

Hindi naman ipinagbabawal ng copyright ang paggamit sa ideas. Lumilitaw pa ang husay ng awtor kapag pinaghahalo-halo niya ang mga sangkap na idea para makapagluto ng isang masarap at kakaibang putaheng nobela. Ang expression of ideas ang nagpapakita sa husay at pagkamalikhain ng awtor.

Ang batas na nagsasaad ng mga karapatan ng mga awtor ay ang Copyright Law na nakapaloob sa Intellectual Property Code of the Philippines. Nagkaroon ito ng epekto bilang batas noong 1998.

Kung totoong hadlang ang copyright sa pagkamalikhain, dapat ay simula pa noong 1998, wala nang mga bagong librong nailathala sa Filipinas.

Teka… bago ka magbigay ng iyong palagay, ako muna ulit.

Si Abdon Balde, Jr. ay civil engineer sa loob ng 33 taon bago naging nobelista at makata. Sa huling bilang ay nakapagsulat na siya ng sampung nobela kung saan ang tatlo ang tumanggap ng National Book Awards: “Mayong” (2003), “Calvary Road” (2004) at “Hunyango sa Bato” (2005). Kamakailan, nagsulat din siya ng bestseller na “60ZENS: Tips on Senior Citizenship” (2010).

Ang pinagsama-samang benta ng anim na libro ni Bob Ong noong 2008 ay lampas na sa 250,000 copies. Sa kasalukuyan ay nakakawalong libro na si Bob Ong. Ang mga libro ni Bob Ong ay binibili ng mga tao lalo na ng mga estudyante kahit na hindi ito required reading sa school. Ang pinakabagong nobela ni Bob Ong ay “Ang mga Kaibigan ni Mama Susan” (2010).

Si Miguel Syjuco ang unang Pinoy na nagwagi sa 2008 Man Asian Literary Prize para sa kanyang unang nobelang “Ilustrado.” Ang premyong tinanggap ni Syjuco dahil sa libro ay 100,000 US dollars o 4.3 million pesos.

Papaanong nakalikha ng bagong libro ang mga awtor na nabanggit, at kumita pa nga, kung hadlang lamang ang copyright sa pagiging malikhain? Ang palagay ko ay nagdadahilan lamang ang mga taong hindi makalikha. Kesyo may copyright, kesyo walang copyright, kesyo mainit, kesyo malamig at kung ano-ano pang dahilan. Kung talagang pagaganahin ang utak ay maaakit natin ang mga musa at magiging malikhain din tayo, may copyright man o wala.

Ito ang palagay ko. Ikaw, ano ang palagay mo?

US EMBASSY REP AND HUNGARIAN COPYRIGHT EXPERT IN FILCOLS HUNTAHAN

This FILCOLS Huntahan will definitely be a different one. First, it’s gender-oriented and second, it will have a dash of international orientation because of the guest speakers.


Jenifer Neidhart de Ortiz, Jennie Ness and Dr. Mihaly Ficsor will be joining the
FILCOLS Huntahan para sa Manunulat na Kababaihan, an informal discussion on writing, publishing, intellectual property and copyright.



It will be held on 28 March 2011 from 1:00-4:00 pm at the Seminar Room, College of Social Work and Community Development, Magsaysay St., UP Diliman, Q.C.



Neidhart de Ortiz is the Trade and Investment Officer of the Economic Section of U.S. Embassy Manila while Dr. Mihaly Ficsor is the President of Hungarian Copyright Experts Council. He used to hold high level positions in the WIPO and UNESCO. He authored a number of books about Copyright, Copyright and the Internet, Collective Management and a lot more.



They will drop by and give a short talk on copyright and collective licensing in the international scene.



This event aims to encourage working together to address challenges in and outside the academe and to promote women writers’ rights in the country.

Writers, Artists and Manila Officials campaign against corruption on Balagtas Day



The Linangan sa Imahen, Retorika, at Anyo (LIRA), the oldest active organization of poets in Filipino, and the Samahan ng Sining at Kalinangan ng Pandacan (SSKP), in cooperation with the Office of Manila Mayor Alfredo S. Lim will gather at the Balagtas Shrine, Pandacan, Manila on April 2, 2011, 7:00 A.M. to honor the country's premiere poet Francisco Balagtas on his 223rd birthday.



Dubbed “Pahayag: Panitikan Laban sa Korupsiyon,” the celebration will feature writers and artists staging a short play in honor of Francisco Balagtas and a "balagtasan," the traditional Filipino debate in verse, by Dr. Michael M. Coroza, Professor Vim Nadera, and the "Prince of Balagtasan," Teo T. Antonio. LIRA will also release a cultural manifesto against corruption in the government.



The highlight of the event will be the crowning of flowers on the statue of Balagtas by Mayor Lim and LIRA's founder and adviser, National Artist for Literature Virgilio S. Almario, a.k.a. the poet Rio Alma. The pair will be assisted by the Knights of the Columbus from the San Fernando De Dilao Parish.

Copyright bilang Human Right


“Hindi mahalaga ang copyright dahil hindi naman ito nakakain,” sabi ng isang estudyanteng nakausap ko kamakailan.


Ang copyright ay isang salitang binuo ng mga legal expert para ipantawag sa proteksiyon na ibinibigay ng batas sa mga malikhaing tao sa ating lipunan. Binubuo ito ng isang bungkos ng mga karapatan na nakasaad sa Intellectual Property Code of the Philippines. Nakapaloob dito ang Copyright Law o ang batas ukol sa copyright.


Dahil madalas na napapalibutan ng batas at nagiging paksa lamang kapag may mga abogado sa paligid ang copyright, marami ang hindi maka-relate sa mga konsepto nito.
Tama ang estudyante! Hindi nakakain ang copyright. Pero mahalaga pa rin ito. Tulad ng maraming bagay na mahalaga kahit hindi naman nailalaman sa tiyan.


Ang copyright ay binigyang-halaga ng mga international agreement o document bilang kabungkos ng human rights. Ibig sabihin, hindi kumpleto ang listahan ng human rights kung wala ang karapatan ng mga malikhaing tao.


Maraming bansa ang pumirma para mapagtibay ang mga dokumentong ito. Dahil nagkaintindihan at nagkasundo ang mga lider sa international stage, pumayag silang ipatupad ang laman ng mga dokumento sa loob ng kani-kanilang mga bansa.


Isa ang Filipinas sa mga bansang pumirma sa Universal Declaration of Human Rights. Ito ay naganap noon pang 1951. At sumang-ayon din tayo sa International Covenant on Economic, Social and Cultural Rights na inilabas ng United Nations General Assembly noong 1966.


Sabi sa Artikulo 23.1 ng Universal Declaration of Human Rights, ang lahat ng tao ay may karapatang magtrabaho, may layang pumili ng trabahong gusto niya, magtrabaho sa isang makatarungan at maayos na lugar, at may proteksiyon mula sa pagkawala ng trabaho.


Ibig sabihin ang tao ay may karapatan (human right) na magtrabaho bilang manunulat, kompositor, pintor, manlililok, photographer, at iba pa kung gusto niya. Dahil may laya siyang pumili ng trabaho ayon sa hilig niya. May karapatan din siyang magtrabaho sa isang makatarungan at maayos na lugar, ligtas at may proteksiyon mula sa pagkawala ng trabaho.


Sabi naman sa Artikulo 23.3, may karapatang makatangap ng karampatang bayad mula sa kanyang trabaho ang kahit sinong tao. Para saan ito? Para sa kanyang sarili at para magkaroon siya ng kakayahang mabigyan ang kanyang pamilya ng buhay na disente at may dignidad.


Ibig sabihin, ang author o malikhaing tao na nagtatrabaho nang ayon sa kanyang hilig o talent ay dapat lang tumanggap ng sapat na kita mula sa kanyang isinulat, iginuhit, inililok, at iba pa. Kung libre o walang bayad, paano niya maitataguyod ang sarili at ang kanyang pamilya?


Sabi naman sa Artikulo 27.2, ang lahat ng bansang pumirma sa Universal Declaration of Human Rights ay gagawa ng batas na magbibigay-proteksiyon sa mga karapatang moral at materyal ng mga lumikha ng gawang siyentipiko, pampanitikan o pansining.


Kung ang Artikulo 23 ay para sa lahat ng naghahanapbuhay at ang karapatan (human right) nilang mabuhay nang may dignidad mula sa kanilang pagtatrabaho, ang Artikulo 27 ay direktang binanggit ang human right ng mga lumikha ng gawang siyentipiko, pampanitikan o pansining.


Ano naman ang mga artikulong may kinalaman sa mga author sa International Covenant on Economic, Social and Cultural Rights? Ito ay ang Artikulo 7 at Artikulo 15.c.

Sa Artikulo 7, nakasaad ang karapatan (human right) ng tao sa karampatang sahod mula sa trabaho. Malinaw rin dito na ang karampatang sahod o bayad ay para sa LAHAT ng nagtatrabaho. LAHAT. Walang etsapuwera. Hindi exempted ang mga author.


Kung ang mga janitor ay nakakatanggap ng sahod sa paglilinis, dapat ang guwardiya ay nakakatangap din ng sahod sa pagbabantay. Ang hindi pagbibigay ng karampatang bayad ay malinaw na violation of human right. Kilabutan kayo kung kayo lang ang kumikita at nabubuhay.


Binanggit din dito ang “equal pay for equal work” at ang halaga ng sapat na kita para mabigyan ang sarili at pamilya ng disenteng pamumuhay. Tandaan, hindi lamang kayo ang may tiyan at pamilya.


Sa Artikulo 15.c, malinaw naman ang obligasyon ng Filipinas na tutukan ang karapatan (human right) ng lahat ng authors ng mga gawang siyentipiko, pampanitikan o pansining na mabigyang-proteksiyon ang kanilang moral at materyal na interes.


Ang mga author ay may tiyan at pamilya rin. Nagbibigay sila ng mga gawang napapakinabangan ng lipunan. Kaya dapat lamang na makinabang din sila. Ika nga “equal pay for equal work.”


Hindi nga nakakain ang copyright pero marami ang nakakapamuhay nang may dignidad dahil sa mga likha tulad ng libro, musika, pelikula, at iba pa. Hindi nga nakakain ang copyright pero maraming pamilya (kasama na ang mga estudyante) ang nakakakain dahil sa mga trabahong umusbong dahil dito.


Inaanyayahan ang mga author, publisher o tagapagmana ng copyright na sumali sa FILCOLS. Ito'y para mabigyang-proteksiyon ang kanilang mga akda. Kailangan lamang ay mayroon kayong published works kung kayo ay author/publisher o nasa inyo ang kapangyarihang magmanage kung heirs kayo ng author. Wala pong membership fee. 30th National Book Awards Open for Nominations

The National Book Development Board (NBDB) and the ManilaCritics Circle (MCC) are now accepting nominations for the 30th National Book Awards for books published in 2010.


NOMINATION/SELECTION CRITERIA

General Guidelines and Definitions

1.Book: A printed and bound volume. At this time, the awards do not cover electronic books. Textbooks or books with exercises meant for classroom use are not considered books for purposes of the awards.

2.Eligible Book: A book copyrighted and published in the Philippines in the calendar year immediately preceding the year of the award is eligible. Except for books authored by members of the MCC and the BOJ, there are no restrictions as regards authorship; authors may be Filipinos or non-Filipinos, individuals or groups, dead or alive. Books published earlier or in the same year outside the country but published independently by a Philippine publisher in the calendar year preceding the year of the award are also eligible.

3. Ineligible Book: A reprint of a book already considered during a previous award year, a second or later edition (even if revised or enlarged), a book with plagiarized passages, a book that infringes on copyright, a book by a publisher not duly registered with the NBDB, a book authored by an NBDB-appointed judge in the category s/he is judging, a book written by a National Artist for Literature, and any title authored by any member of the MCC are automatically disqualified from competing for the awards. Likewise, a book without an international serial book number (ISBN) is disqualified.

4.Nominated Book: A book may be nominated if it is better written and more significant than other books in its category. Writing includes mechanics or grammar, typographical errors, copy editing, structure of thought and ideas, and style. Significance includes original contribution to its field of study or interest, accuracy of data, and reader impact. The reputation of the publisher, distribution, and actual sales figures are irrelevant to the awards.

5.Design: Except for the award for Best Design, the design of a book is secondary to content in the selection of the finalists and winners, unless the design seriously hampers the delivery of the content.

6.Divisions: There shall be two divisions: Literary and Non-Literary with specific categories within each Division further described in these rules.

7. Publisher: A registered NBDB publisher, foundation or association or ongoing business engaged in publishing, developing and distributing printed material, or has published a book for a special purpose may nominate a book.

Small and independent publishers who are unable to register with the NBDB for lack of the required documents and/or ISBNs may still submit nominations to any of the categories in any of the divisions; however, they may only be awarded a citation and not the National Book Award.

Professional organizations and ongoing businesses that submit titles for consideration must also submit a copy of their SEC registration to the NBDB.




I. LITERARY DIVISION

1. Literary Categories

Literary Awards are given to books that include or are about creative writing. These include the following: Fiction, Nonfiction Prose, Poetry, Literary Criticism and Graphic Literature.
Regional Language – For this year’s awards, the NBDB and the MCC are now accepting works in Cebuano for any of the categories of the Literary Division. A nominated book can be a translation of a work, or originally written in the Cebuano language.
Books published in Cebuano within the last three calendar years (2008-2010) will be accepted for this year’s awards.

1.1. Fiction (Novel and Short Fiction) – a book that contains a full-length story (i.e., a novel) of at least 50,000 words, or a collection of two or more short stories, or stories not long enough to be novels.

A nominated book offers a narrative that follows the conventions of the writing of long literary fiction, such as plurisignification, logical structure, consistency of characterization, and precision in the use of language and literary devices. The book may deliberately challenge these conventions, but there should be clear evidence that the novelist has done so not out of ignorance but out of deep knowledge of the tradition of the novel.

A winning book both delights and instructs, offering breadth and depth comparable to the Philippine novels earlier given National Book Awards. If two or more books are tied for the award, the one that is better written in terms of literary quality is declared the winner.

Just in case there is a novel and a collection of stories competing for the award, and they are both deserving of the award, both will be given the National Book Award.



1.2. Nonfiction Prose– A full-length literary nonfictional work or collection of short literary nonfictional works, including personal essays, autobiographies, biographies, memoirs, and other genres included in the broad category of creative nonfiction.

If two or more books are tied for the award, the one that is better written in terms of literary quality is declared the winner.

Just in case there is a full length and a collection of essays competing for the award, and they are both deserving of the award, both will be given the National Book Award.

1.3. Literary Criticism / Literary History – a book that contains either a continuous work or several articles in the field of literary criticism, literary theory, or literary history.

A nominated book shows evidence of the author's having taken into account the latest books in literary theory, both local and foreign. The book must apply tools derived from contemporary theory to texts created by Philippine writers, though it could also contain analyses of works by non-Philippine writers.

A winning book is at the cutting-edge of literary theory, criticism, or history, exploring new areas of scholarship or reading that goes beyond what is already available in academic circles. If two or more books are tied for the award, the one that offers a new literary theory or a new component of an existing literary theory or that presents a new reading of texts is declared the winner.

1.4. Poetry – a book that contains either a continuous poem or several poems.

A nominated book offers poems that follow the conventions of poetry, whether of traditional, modern, or avant-garde poetry, including but not limited to the interaction of sound and sense, profound sensibility, and awareness of poetic genres.

A winning book offers fresh insights into the human condition, particularly the condition of Filipinos inside or outside the country.

1.5. Graphic Literature – a book that contains autobiography, creative nonfiction, fiction, or other literary genre, but in graphic or illustrated, rather than purely verbal form.

A nominated book offers a narrative or anthology of narratives that follows the conventions of the writing of literary graphic fiction, such as congruence of verbal and illustrated content, logical structure, consistency of characterization, and precision in the use of visual and literary devices.

A winning book both delights and instructs, offering breadth and depth comparable to the Philippine graphic novels, anthologies, or comic books earlier given National Book Awards. If the book is a collection of separate texts, there should be a unifying theme or motif among these texts. If two or more books are tied for the award, the one that is better written in terms of literary quality is declared the winner.

2. Nomination

Any publisher defined in the General Guidelines and Definitions registered with the National Book Development Board (NBDB) may nominate a literary title as defined above, published in the previous year (except for those books published in Cebuano), by sending a letter of nomination and by submitting an initial six (6) copies of that title for consideration of a chosen literary organization in the above categories, in English, Filipino, or any other language. The publisher must clearly state in the letter of nomination under which category he wants his title considered.

The 6 initial copies shall go to the following:
a. each member of the Prescreening Committee;
b. the NBDB library; and
c. the NBDB-chosen design outfit/book designer.

3. Prescreening Committee

There will be four (4) persons who shall be designated to prescreen the nominated books in the whole Literary Division, who shall be:

3.1 A nominee from a literary organization or a person who is an expert in the field -The NBDB shall select a literary organization, which shall be asked to nominate one (1) member to serve in the prescreening committee of the NBA, or a known expert in the field to prescreen the nominations. In the case of a literary organization, it shall be given five (5) days from receipt of the letter asking them to nominate a member, after which the NBDB reserves the right to select another literary organization;

3.2 A nominee of the NBDB- The NBDB shall nominate one (1) person of competent expertise, who shall also be the NBDB’s permanent judge for this division; and

3.3. Two members of the MCC- The MCC shall elect two (2) members from its ranks to be part of the prescreening committee, who shall not necessarily be the same members of the prescreening committee in the other division but must be part of the BOJ.

Prescreening of books in Cebuano-The NBDB and the MCC shall nominate one (1) judge each who shall prescreen all the books in all the categories for the Literary Division. These judges must also necessarily be part of the BOJ for the Literary Division.
They shall choose no more than five (5) finalists for each category which shall be elevated to the BOJ.
The Prescreening Committee shall choose no more than five (5) nominees by a majority vote to become finalists, which titles shall be elevated to the BOJ for the final determination of the winner.

All meetings by the Prescreening Committee shall be scheduled beforehand by the NBDB and shall be documented by a member of the NBDB Secretariat.


4. Finalists

The Prescreening Committee shall select no more than five (5) titles per category, which 5 titles shall automatically be considered finalists from which a winner for that particular category shall be chosen. The choice of finalists by the Prescreening Committee shall be by majority vote of the members of the Prescreening Committee, and all decisions of the Prescreening Committee shall be final.


5. Notice to Finalists

Publishers of titles chosen as finalists by the Prescreening Committee shall be informed in writing by the NBDB that their titles have been chosen as finalists in the specific categories indicated, and shall be required to submit an additional five (5) copies of the books to the NBDB. Non-submission of the required copies will disqualify the title from consideration by the BOJ.

The NBDB shall inform the BOJ no later than August 15, 2011, that the books to be the subject of final judging are ready for pick up at the NBDB office.


II. Non-Literary Division

1. Non-Literary Categories

Non-Literary Awards are given to books that do not include nor are about creative writing, except that such creative writing techniques may be used occasionally to enhance the text.

1.1. Art – a book that focuses on any of the art forms (including photography, film, and television), except literature. A collection of essays on art by a single author or by several authors, provided the essays are not primarily literary or creative, is classified under this category. For purposes of the awards, photojournalism is considered an art form.

A nominated book offers fresh and original insights into the work/s of a visual, performing, electronic, or other type of artist/s. If the book is a collection of separate texts, each text must have the characteristic listed above. A book featuring mostly photographs of artworks may be nominated if the prose portion is substantial.

A winning book is itself a work of art, blending design with content, style with the style of the artist/s discussed. If two or more books are tied for the award, the one that offers a more comprehensive account of the body of work of an artist or artists is declared the winner.

1.2. Professions - a book that focuses on law, medicine, accounting, engineering, or other professions requiring licensure examinations, and the application of these professions to daily life.

A nominated book is meant primarily for the general reading public and not for other professionals (such as lawyers, law students, doctors, medical students, engineers, and so on). It must offer accurate and useful advice based on existing laws, medical knowledge, or other professional practice. It must be well-written in terms of style, with a readability level as high or lower than that of educated non-professionals. If the book is a collection of separate texts, each text must have the characteristics listed above.

A winning book is a full-length text that does not falter in places but keeps a consistent tone. If two or more books are tied for the award, the one that focuses on lesser known aspects of the profession is declared the winner.

1.3. Science – a book in the area of any of the natural or physical sciences.

A nominated book is meant primarily for the general reading public and not for scientists or science students. It must be well-written in terms of style, with a readability level as high or lower than that of educated adults without science degrees. If the book is a collection of separate texts, each text must have the characteristics listed above.

A winning book is a full-length text that does not falter in places but keeps a consistent tone. If two or more books are tied for the award, the one that focuses on lesser known aspects of science is declared the winner.

1.4. Social Sciences – a book in the area of any of the social sciences, including history, religious studies, and interdisciplinary studies.

A nominated book offers a fresh and original insight into its subject, in an expository style that displays correct and precise use of language, accuracy of data, extensiveness of research, and awareness of audience impact. If the book is a collection of separate texts, each text must have the characteristics listed above.

A winning book is a full-length text that does not falter in places but keeps a consistent tone. If two or more books are tied for the award, the one that focuses on less explored aspects of the social sciences is declared the winner.

1.5. Leisure – a book about travel, tourism, sports, sports management, food, fashion and other such areas.

A nominated book offers a fresh and original insight into its subject, in an expository style that displays correct and precise use of language, accuracy of data, extensiveness of research, and awareness of audience impact. If the book is a collection of separate texts, each text must have the characteristics listed above. A book featuring mostly photographs may be nominated if the prose portion is substantial.

A winning book is a full-length text that does not falter in places but keeps a consistent tone. If two or more books are tied for the award, the one that inspires more readers to take up a leisure activity or that offers newer or more information on leisure activity matters is declared the winner.


2. Nomination

Any publisher as defined in the Guidelines and Definitions may nominate a title published in the previous year, by submitting a letter of nomination for the above categories. Publisher who nominates their titles must also submit six (6) initial copies of that title for consideration of the judges. The publisher must clearly state in the letter of nomination under which category he wants his title considered.

Submissions by university departments must contain the signature of the head of the department, or an authorized department representative as designated by the dean of the college or the university president.

The 6 copies shall go to the following:
a. Each member of the Prescreening Committee;
b. The NBDB library; and
c. the NBDB-chosen design outfit or book designer.


3. Prescreening Committee

3.1 A nominee from a non-literary organization selected by the NBDB-The NBDB shall select a professional organization, university department, or an an expert from the specific field to be part of the prescreening committee. In case of a professional organization or university department, it shall be asked to nominate one (1) member to serve in the prescreening committee of the NBA. The chosen professional organization or university department shall be given five (5) days from receipt of the letter asking them to nominate a member, after which the NBDB reserves the right to select another professional organization, university department, or an individual who is a known expert in the field;

3.2 A nominee of the NBDB- The NBDB shall nominate one (1) person of competent expertise, who shall also be the NBDB’s permanent judge for this division; and

3.3. Two members of the MCC- The MCC shall elect two (2) members from its ranks to be part of the prescreening committee, who shall not necessarily be the same members of the prescreening committee in the other division.

The Prescreening Committee shall choose no more than five (5) nominees by a majority vote to become finalists, which titles shall be elevated to the BOJ for consideration.

All meetings by the Prescreening Committee shall be scheduled beforehand by the NBDB and shall be documented by a member of the NBDB Secretariat.


III. Design

1. Design – the overall design of a book, including but not limited to the cover design, the choice of typefaces, the dimensions of the page, the lay-out, the type of paper, the binding, and the printing.

1.1. The award for Best Design is not intended to be limited to coffee table books; an inexpensive book without pictures or illustrations can be better designed than an expensive one with pictures or illustrations.

1.2. A nominated book combines all the elements of design into a coherent whole, supplementing but not supplanting the content of the book.

1.3. A winning book entices the reader to read the contents carefully while admiring the way the book looks. If two or more books are tied for the award, the one that offers a more innovative way to use the elements of design is declared the winner.

2. Prescreening by NBDB-chosen Design Outfit/Book Designer

All nominations shall be eligible for this category, the finalists of which shall be chosen by the nominee of the NBDB-chosen design outfit or book designer, who shall choose no more than five (5) finalists for the Best Book in Design. The nominee of the NBDB-chosen design outfit shall automatically be part of the BOJ for this category.


The Board of Judges

1. Composition

Every year, each Division of the National Book Awards shall be composed of a Board of Judges (BOJ) composed of:

Five (5) members of the Manila Critics Circle (MCC) to be designated by the MCC, two of whom shall be the members of the Prescreening Committee of each division; and

Two (2) judges nominated by the National Book Development Board (NBDB), each of whom shall be the NBDB-nominated members of the Prescreening Committee for each Division, who shall also be designated as the NBDB’s permanent judge in the BOJ for a particular division.

The MCC may designate among themselves the member of the BOJ for each category of both the literary and non-literary divisions; however, the MCC-designated members of the Prescreening Committee shall always be part of the BOJ for the particular divisions they screened.

The NBDB reserves the right to nominate a different judge for each category within any division, depending on the expertise of the chosen judge, who may or may not be the same judge nominated by the NBDB-chosen prescreening organization.

Books of members of the MCC and the NBDB-appointed member of the Prescreening Committee are disqualified from winning any award for any category in any division. Likewise, the books of the NBDB-chosen prescreening organization’s nominee shall be disqualified for the category s/he is judging.

2. Voting

Each member of the BOJ is entitled to one (1) vote. A vote must be explained verbally during the voting process, taking into consideration factors that determine the quality of the title. A title in all categories of both divisions must be voted upon by the majority of the BOJ to win. All decisions of the BOJ are final.

3. Meetings

Meetings of the BOJ shall be held at the NBDB Conference Room or at any designated place agreed upon beforehand by the members of the BOJ with the agreement of the NBDB.

Minutes of every meeting by the BOJ shall be taken by a member of the NBDB Secretariat, who shall keep the minutes in a confidential file within the premises of the NBDB.

4. Deadline for Winners

A winner for each category must be determined by October 30, 2011. The winner of each category, except Publisher of the Year, will receive a cash prize of Fifteen Thousand Pesos (P15,000.00), which will be awarded to the author or book designer, as the case may be, and not to the publisher. Citations do not win cash prizes.

There will be Special Awards; such as Juan C. Laya Prize, Alfonso T. Ongpin Prize, Bangko Sentral ng Pilipinas Prize, and Isagani R. Cruz Prize, which will be chosen from among the winners of the National Book Awards.

Youngest Copyright Owner?





Most probably, you were still sucking your thumb when you were five or six years old. Yes. Just like everybody else.



But not Kale Yohance Fernandez , one of the youngest copyright owners in the country.



Kale’s just turning six this August but his thumb is already busy assisting his other fingers fidgeting with a camera. Not a toy camera but a real, expensive one owned by his father, Dexter Fernandez.



Dexter and his family hail from the city of smiles, Bacolod City, Negros Occidental. He is a serious photography hobbyist and goes by the name Manong Kodakero. He specializes in documenting weddings, events and parties. He also does product shoots and private photo sessions in Boracay Island, Bacolod, Kalibo, Himamaylan, and Metro Manila.



He noticed Kale’s curiosity in photography when Kale was still a toddler. Kale would always touch the camera being used to take pictures of himself. And later on, he would try to grab the camera from his father.



So Dexter nicknamed him Junior Kodakero. And when Junior Kodakero was already big enough to take pictures by himself, he got his first assignment (from who else but The Senior, Manong Kodakero, of course).



It was the documentation of Brazilian Capuera Showmanship at the Event Center of SM Bacolod held last February 2011.



Well, did he do it right?

As for being one of the youngest copyright owners in the country, all Kyle has to do is to sit back, relax and then shoot some more. More photos will mean more of his creations and works that can be attributed to him as the creator.



Yes, that’s right. One doesn’t have to be “old” or at the right age to be a copyright owner. All one needs is originality, creativity, time and effort. And voila, you can be a copyright owner of anything that you make or produce.

Buhay na Titik: Copyright sa Universal Declaration of Human Rights

Copyright sa Universal Declaration of Human Rights


Wala ang salitang “copyright” sa Universal Declaration of Human Rights.


Oo, kahit isa-isahin mo ang bawat deklarasyon ay hindi mo makikita ang salitang
“copyright” dito. Ibig bang sabihin ay walang halaga ang talakayan natin tungkol sa copyright?


Teka, bago ko sagutin ‘yan ay meron muna akong tanong sa 'yo.


Alam mo bang walang salitang “Filipinas” sa ating Pambansang Awit? Ang pamagat
nito ay “Lupang Hinirang” at kahit na isa-isahin mo ang bawat taludtod nito ay
hindi mo makikita ang salitang “Filipinas” dito. Ibig bang sabihin ay
wala naman palang kaugnayan ito sa ating bansang Filipinas?


Siyempre, hindi ang sagot sa dalawang tanong. Dahil kahit wala ang salitang
“copyright” sa Universal Declaration of Human Rights ay nakapaloob naman ang
konsepto nito sa mga pertinent na artikulo. At kahit wala ang salitang
“Filipinas” sa “Lupang Hinirang” ay nakapaloob ang kaluluwa ng ating bayan sa
bawat taludtod ng pambansang awit.


Ang salitang copyright ay isang terminong legal. Ibig sabihin ito ay salitang
inimbento ng mga expert sa batas para magkaisa at magkaunawaan kapag
pinag-uusapan ang karapatan ng mga manunulat, kompositor, at iba pang
malikhaing tao na siyang creator ng mga gawang literary, artistic, at scientific.


Ganito rin ang nangyari sa Filipinas. Maraming pangalang ibinigay ang iba’t
ibang tao o pangkat ng tao sa ating bayan tulad ng Felipinas, Las Islas
Filipinas, Islas del Poniente, San Lazaro, Republica Filipina, at Philippine
Islands.


Alam nating ang pinagmulan ng pangalang Filipinas ay ang haring Felipe
ng Espanya. Pero isa sa sinaunang gumamit ng pangalang ito ay si Philip II na hari ng Macedonia. Siya ang ama ni Alexander the Great. Ang pangalang Philip ay kombinasyon ng dalawang salitang Greek na “philos” o kaibigan at “hippos” o kabayo. Ibig
sabihin ng pangalang Philip ay taong maibigin o mahilig sa kabayo.


Isang tanong: e bakit konti lang ang mahilig sa kabayo sa Republika ng Filipinas?


Para magkaisa at magkaintindihan ang mga tao ay idineklara ng mga mambabatas na
ang official name ng ating bayan ay Republic of the Philippines.
Makikita ito sa ating Saligang Batas 1935 (Article 18, sec. 1).


Alam nating ang pinagmulan ng copyright ay ang Statute of Anne noon
1710. Ito ay naka-focus sa karapatan ng may-akda na magparami ng kopya ng kanyang
mga aklat sa pamamagitan ng printing o right to copy. Mula sa right to copy or
print books ay lumawak ang sakop ng copyright.


Sa kasalukuyan ang copyright ay isang bungkos ng mga karapatan.
Siyempre nasa una pa rin ang “right to copy” na ang legal term ay “reproduction right.” Ang ibang karapatan sa ilalim ng Copyright Law na nakapaloob sa Intellectual
Property Code of the Philippines ay ang mga sumusunod: dramatization, translation,
adaptation, abridgement, other transformation of the work, first public distribution,
rental, public display, public performance, at other communication to the
public (IP Code Chap. V, sec. 177.1 -177.7).


Isa sa naging basehan ng ating IP code ang Universal Declaration of
Human Rights na binuo noong 1948.


Dalawang articles ang masasabing pundasyon ng copyright sa ating batas mula sa
Universal Declaration of Human Rights. Una, ang lahat ng tao ay may karapatang
magtrabaho, may layang pumili ng trabahong gusto niya, magtrabaho sa isang
makatarungan at maayos na lugar, at may proteksiyon mula sa pagkawala
ng trabaho (Article 23.1).


Kasunod nito ay ang karapatan ng bawat nagtatrabaho na makatangap ng
makatarungan at “favourable remuneration” para sa kanyang sarili at para magkaroon siya ng kakayahang mabigyan ang kanyang pamilya ng buhay na may dignidad
(Article 23. 3).


Ikalawa, dapat bigyang-proteksiyon ang mga karapatang moral at materyal ng mga
author ng gawang scientific, literary, at artistic (Article 27.2).


Ang mga may-akda ay manggagawang dapat kumita nang sapat at mabigyan ng karampatang bayad sa bawat gamit ng kanilang mga akda o gawa. Bakit? Sapagkat may katawan din silang kailangang pakainin at may pamilyang dapat itaguyod at mabigyan ng buhay na may dignidad.


Hindi ako sang-ayon sa panukala ng ilan na dapat isantabi ang copyright dahil
imbensiyon lang ito ng mga abogado at ni hindi naman ito nabanggit sa Universal Declaration of Human Rights. Kung gayon ay dapat na ring isantabi ang Filipinas dahil wala namang mahilig sa kabayo dito.


Kailangan nating magkaisa at magkaunawaan sapagkat maraming kabuhayan
at maraming pamilya ang nakasalalay ang kita sa copyright.


Inaanyayahan ang mga authors, publishers o tagapagmana ng copyright na sumali sa FILCOLS para lalo pang mabigyang-proteksiyon ang kanilang mga gawa. Wala pong membership fee. 2nd National Children’s Book Award slated for 2012

The 2nd National Children’s Book Awards will be presented by the National Book Development Board (NBDB) and the Philippine Board on Books for Young People (PBBY) in the year 2012 for books published in 2010 and 2011. Originally envisioned as a yearly event to honor significant children's books which exemplify the marriage of text and art, NCBA will instead be held on alternate years as the present number of entries, regrettably, does not as yet warrant a yearly competition.Once this situation is seen to have improved, the NCBA will only be too happy to revert to a yearly competition. This revision will also mean that this current cycle will intersect with the period celebrating the 150th anniversary of Dr Jose Rizal's birth and hopefully result in new Rizaliana for the youth. It must be remembered that the NCBA initiative is also meant to document the state of children's publishing in the country and to promote quality books for homes and school libraries.


The NBDB and PBBY began awarding the NCBA in 2010, in recognition of the best Philippine-published children’s books, including both works of fiction and nonfiction. Last year’s winners were picked out of 131 nominated books published in 2008 and 2009. Only six titles from four publishers were selected by a board of judges who publicly discussed the merits of the books during the awards ceremony. The competition guidelines stipulate a maximum of ten noteworthy titles for possible citation.



Last year’s NCBA winners were Araw sa Palengke (Adarna House) written by May Tobias-Papa and illustrated by Isabel Roxas; Tuwing Sabado (Lampara Books) written by Russell Molina and illustrated by Sergio Bumatay III; Can We Live on Mars? (Adarna House) written by Gidget Roceles-Jimenez and illustrated by Bru; Lub-Dub, Lub-Dub (Bookmark) written by Russell Molina, a FILCOLS member, and illustrated by Jomike Tejido; Tagu-Taguan (Tahanan Books) written and illustrated by Jomike Tejido; and Just Add Dirt (Adarna) written by Becky Bravo and illustrated by Jason Moss.



The nomination period for the 2012 NCBA will be announced shortly.

WOMEN'S MONTH CELEBRATION AT POWERBOOKS



FILCOLS Member-Publisher Anvil Publishing and whose Publishing Manager Karina Bolasco is FILCOLS' Vice Chair celebrates WOMEN’S MONTH by holding a joint book signing on Anvil’s latest books by, for and on WOMEN. The featured books are of varied genres focused on women readers. The authors will be present to talk about their books and sign copies on March 15, 6pm in Powerbooks Greenbelt 4 in Makati.


In the literary category are a collaborative novel entitled ANGELICA’S DAUGHTERS written by 5 accomplished women writers Cecilia Brainard, Nadine Sarreal, Susan Evangelista, Erma Cuizon and Veronica Montes. Unique in its development, this is a saga of three generations of women whose lives are deeply affected by important periods in Philippines history.



In the creative non fiction genre are a collection of essays entitled RICH LIFE by journalist Joy Posadas and PEACE WARRIORS, a narrative on Mindanao by journalist Criselda Yabes and a book on the TEN OUTSTANDING STUDENTS OF THE PHILIPPINES (TOSP) entitled Every Day Great Examples (E.D.G.E.). The essays in Rich Life focus on major concerns of women such as The life/work balance, Passion and fulfillment in one’s career and financial security and independence, among others. PEACE WARRIORS is an eloquent travelogue/exposition on Mindanao and how different sectors of society, particularly the military, attempt to forge peace between different groups. Yabes weaves a richly layered story that fuses her personal history (as a Mindanaoan) and her profession (as a journalist covering the area).



E.D.G.E includes profiles of TOSP alumna Cecile Guidote Alvarez, Soledad Aquino-Hernando, Pamela Gracia Concepcion C. Asis, Patricia Licuanan, Sonia Roco, Victoria Garchitorena, Edna Manlapaz and Noralin Mangondato Sharief-Ador. The profiles were written by accomplished women writers Emelina S. Almario, Rica Bolipata Santos, Elsie Kalaw Santos, Francisco H. Bautista, Purita C. Salas, Elvira Pelaez-Marfori, Anita Feleo, Tina Arceo-Dumalo, among others.



In the social science category are two books that present an alternative view of World History by Christine Diaz. Written in engaging prose, these books are history — sans the dates and names that students all had to commit to memory—its greatest moments, its unforgettable episodes and how they all come to bear in present society. Autor Diaz explains that the books ‘relate the events in history to current realities’. The (hi)storytelling is done with a touch of humor and suspense and the reader soon finds himself nodding in agreement and moved by a touching insight or episode. Diaz also wrote the critically acclaimed THE OTHER PHILIPPINE HISTORY TEXTBOOK.



In the children’s book category are BITUIN by Inquirer columnist Ceres Doyo and PAIKOT IKOT by Irene Sarmiento. Doyo’s Bituin tells the story of a child whose home is ravaged by the storm Ondoy and how their family and community thrive in extreme conditions while PAIKOT IKOT is an engaging narrative of an autistic child written by child psychologist Sarmiento.



In the self help category, are three books that will benefit women who are considering an entry into entrepreneurship. These are Restaurant Management 101 by Les Roches trained Rosanna Gonzalez, Food Business Ideas by Vicky Veloso Barrera and Vegetarian Cookbook by veteran food writer Dolly Dy. These books provide practical advise on how to turn a homemaker’s cooking skills and know how into viable enterprises.

PHILIPPINE PEN HOLDS THE LITERATURE WORKSHOP

MANILA, Philippines - The Philippine Center of International PEN (Poets, Playwrights, Essayists, Novelists) will conduct a series of teaching literature workshops in Manila and in selected regions in the Philippines this year. Called “The Literature Workshop: Teaching Philippine Literature in High School and College,” this project is geared toward retooling and upgrading the skills of literature teachers in both secondary and tertiary levels.



In the 2010 Cebu Congress, Philippine PEN passed the following resolution: “We resolve to … work more closely with the education sector, its leaders, planners and administrators, its teachers and students, and the education publishing industry, to improve literature education in the country. The Philippine PEN recognizes that literary taste is shaped in the schools, especially the public school system; it is where generations must be taught to appreciate the outstanding works of our very own writers, works that constitute the soul of our nation….”



The first lecture-workshop on teaching Philippine poetry and fiction will be held on March 25, Friday, from 8:30 am to 4:30 pm, at Far Eastern University’s University Conference Center in Morayta, Manila. PEN authors and university professors Gemino Abad, a FILCOLS Board Member, and Danilo Francisco Reyes will be the facilitators.




The Literature Workshop is co-hosted by Far Eastern University, and supported by PEN International in UK, and the Swedish International Development Cooperation Agency (SIDA).

3-N-1/ 10-10-10: WRITING-ON-SITE WORKSHOP FOR STAGE, TV, and FILM

FILCOLS Member NICOLAS B. PICHAY, writer, lawyer, recipient of the Palanca Hall of Fame for having won at least 5 First Prizes in the yearly literary contest, and newly-arrived from New York where he spent six months on a Theatre Grant provided by the Asian Cultural Council, announces the 3-n-1/ 10-10-10: Writing-on-Site Workshop for Stage, TV, and Film as he invites ten (10) writers, to take an exciting writing journey with him for ten (10) consecutive Saturdays, learning, re-discovering, re-enforcing and discussing dramatic writing for Stage, TV, and Film with a registration fee of —you guessed it—ten (10) thousand pesos.



Unlike other technical writing workshops that are heavy on theoreticals, 3-N-1/ 10-10-10 is process and technique oriented. The syllabus is designed to tap into the creative aspect of the writer’s subconsicous as well as to develop the formal skills needed to improve one’s command of the dramatic narrative structure. The workshop is designed to impart core skills to effectively write and pitch scripts for stage, tv or film.



Each participant will be challenged to write a scene at every meeting with the expectation that he or she will complete a dramatic work at the end of the workshop. The workshop will also give out practical advice on how a script can be produced.



Tentative workshop dates and time are the ten Saturdays from 30 April to 02 July 2011; 2-6pm. The venue of the workshop will be in the Origin8 offices along Araullo Street, San Juan, Metro Manila.

NORCODE's Visit





Norwegian Copyright Development Association or simply NORCODE visited the Philippines last February 2011. FILCOLS hosted a dinner meeting for NORCODE’S Saemund Fiskvik, the copyright coach and Frode Lovik, the managing director and FILCOLS’ Board Officers and Members last 21 February 2011 at the Café Adriatico, Mall of Asia, Pasay City.




FILCOLS receives support from NORCODE and Kopinor. NORCODE is an international copyright development group funded by five copyright societies namely KOPINOR, GRAMO, TONO, BONO and NORWACO. KOPINOR is the reproduction rights (RRO) of Norway while FILCOLS is the RRO of the Philippines.

Ang dokumentong Universal Declaration of Human Rights ay binuo at pinagtibay ng United Nations noong 1948. Tatlong taon matapos ang World War II ay nagbigay ng iisang pahayag ang mga bansa sa buong mundo na tapos na ang panahon ng pagsasawalang-bahala sa karapatan ng bawat tao.


Alam natin mula sa kasaysayan na naging malupit at madugo ang mga pangyayari noong World War II. Sa Europe ay pinangunahan ni Adolf Hitler ng Nazi Germany at ni Benito Mussolini ng Fascist Italy ang pagtrato sa bawat tao bilang mga kasangkapan lamang para maisagawa ang pananakop sa buong mundo. Sa Asia ay pinangunahan naman ito ni Emperor Hirohito ng Japan. Ibig sabihin, nang mga panahon na ito, may halaga lamang ang tao kung siya ay nakakatulong o nagagamit sa pangarap ng mga nabanggit na pinuno na maging Masters of the World.


Ang sinumang humahadlang o sumusuway sa pagkamit sa pangarap na ito ay pinagmamalupitan. Kinakamkam ang lahat ng ari-arian, kinukulong pati na ang kanilang mga mahal sa buhay, at kinikitil ang buhay.


Hindi lamang isa o dalawang tao ang naging biktima ng ganitong uri ng karahasan. Walang pinipili ang mga mapaniil: lalaki, babae, bata, matanda, pari, madre, rabbi, manunulat, propesor, sundalo, o pulubi man.


Ang mga manunulat ay hindi maaaring magpahayag ng totoong damdamin. Ang State propaganda lamang ang maaaring gumawa nito. Ang mga pintor ay hindi puwedeng gumuhit ng kahit ano na bugso ng inspirasyon. Tanging ang magpapaganda lamang sa imahen ng mga taong nasa kapangyarihan ang maaaring iguhit ng mga pintor.


Milyon-milyon ang kinulong at namatay sa loob ng mga concentration camp. Ang tao ay itinuring na pinagkukunan ng resources lamang. Ang mga gintong ipin ay binubunot para lusawin bilang alahas. Ang mga malakas ay ginagawang manggagawa sa mga pagawaan ng bala at iba pang gamit sa gera. At kapag nagkasakit at mahina na ang isang tao ay dadalhin sa malalaking oven para sunugin. Ang mga buhok sa katawan ay binubunot at inaahit para lamang gawing lining sa mga boots at jacket ng mga sundalong Nazi na nakikipaglaban sa gera sa Russia. Pagkatapos, kapag kalbo na ang mga ito, papatayin sila at susunugin sa mga oven. Ang abo naman ay ginagawang panambak sa mga kalsada.


Ito ay malinaw na pagsasawalang-bahala sa karapatan ng mga tao. Ngunit may mga nagningning na hiyas sa gitna ng kadiliman ng panahong ito tulad na lamang ni Anne Frank na namatay sa concentration camp subalit ang aklat niyang “Diary of a Young Girl” ay patuloy na binabasa ngayon. Marami ring naging santo sa gitna ng impiyernong ito tulad ni St. Maximillian Kolbe na ibinigay ang sariling buhay kapalit ang paglaya ng isang Hudyo. Si Kolbe ay isang paring Pransiskano at nakulong kasama ang mga Hudyo sa isang concentration camp.


Pagkatapos ng kabaliwang dulot ng gera ay nagkasundo ang mga pinuno ng mga bansa na tapos na't hindi na mauulit pa ang panahon ng pinakamalupit na karahasan.


Ang United Nations ang siyang nagtipon sa mga pinuno at nagdeklara na ang dokumentong Universal Declaration of Human Rights ang siyang magiging batayan ng mga batas na makatao, mga patakaran ng Estado na magbibigay-proteksiyon at paggalang sa karapatang pantao.


Inaanyayahan ang mga author, publisher o tagapagmana ng copyright na sumali sa FILCOLS para mabigyang-proteksiyon ang kanilang mga gawa. Wala pong membership fee. 2011 Academic Publishing Conference and Mini-Book Fair

NBDB in partnership with FILCOLS and De La Salle University- Bacolod present 2011 Academic Publishing Conference and Mini-Book Fair. It will be held on March 3 and 4, 2011 at the De La Salle University-Bacolod, Bacolod City.

Welcome remarks will be delivered by Dr. Nona Ricafort, Commission on Higher Education Commissioner and member of the NBDB governing board.

For the first day, Atty. Andrea Pasion-Flores, the Executive Director of NBDB, will introduce National Book Development Board and how it can be of service to the Academic Publishers.

A representative of the Holy Angel University Press will also deliver a talk entitled Creating a Niche in the Academic and Scholarly Publishing Market.

Professor Oscar V. Campomanes of Ateneo de Manila University will discuss The Basics of Writing Articles and the Journal Review Process.

Engineer Luwin dela Concha of Intellectual Property Office of the Philippines will discuss Copyright 101: Copyright Basics for Publishing.

FILCOLS' Executive Director Alvin Buenaventura will encourage everyone to write and publish through his talk entitled FILCOLS: Enforcing the Economic Right of Copyright Owners.

The second day will kick off with a lecture by David Ong, the Program Lead of Vee Press and Vibal Foundation. It is entitled E-publishing for Academic Publishers.

FILCOLS' Chair and the Director of DLSU Manila Academic Publishing Office Isagani Cruz will talk about The Academic Publishing Market and Distribution Channels and Putting Together an Academic Journal.

And last but not the least, Unyon ng mga Manunulat sa Pilipinas Chair Engineer Abdon Balde, Jr. will teach everyone how to market academic titles.

All presidents, heads of public and private higher education institutions are invited.

This event aims to assist university-based and small publishers in developing their publication program.

Post- event FILCOLS Talk about Copyright at PASAP Meeting










“Today, everyone will realize that copyright is not just a boring term dug up from the field of law.”

That was the premise of the talk of Mr. Alvin Buenaventura, the Executive Director of Filipinas Copyright Licensing Society or FILCOLS. It was held at the Conference Rooms 3 and 4, Social Sciences Building, Ateneo de Manila University, Loyola Heights, Quezon City last 28 February 2011.

The participants were mostly members of the Philippine Association of Scholarly and Academic Publishers or PASAP. Present were representatives from University of the Philippines Press, University of Santo Tomas Publishing House, De La Salle University Press, Ateneo de Manila University Press, the host of the event, Far Eastern University, Centro Escolar University, FEATI, New Era University, Phoenix Publishing, Vibal Publishing and many more.

Everyone listened attentively as Buenaventura expounded on how copyright must be perceived as a human right as well. That of the authors’.

After the talk came the questions.

Ms. Elisa Valdez asked if the theses and dissertations are covered by the FILCOLS proposal.

Buenaventura said that all of the educational institutions are encouraged to come up with their own intellectual property policies. These policies must be designed to give protection not just to faculty members’ works but to students’ works as well. Because the students’ works are still copyrighted materials even if the students were guided by their professors till their works were considered done.

Luisa Camagay of UP Press asked about the state of the state universities and colleges and FILCOLS’ licensing agreements.

Buenaventura said that FILCOLS is prioritizing private higher educational institutions. He believes that students from state universities and colleges might just perceive the “blanket fee” as an additional tax and burden in the education sector. More awareness programs will be set up and executed to prepare the students studying in government funded schools.

Kathlin Aspiras inquired about the selling of second hand books.

Buenaventura assured her there is no copyright violation in that practice. Because the book was not transformed into another form. The content and more importantly the same physical (and worn out) form of the book are what’s being sold. Photocopying is a way of reproducing a book or parts of it in another form. Doing that without the permission of copyright holders is clearly a copyright violation.

Jack Wigley shared his worries about all the hassle of securing permission from copyright holders. This practice might discourage text book authors because of the volume of permissions they have to seek and secure in writing text books.

Buenaventura shared what FILCOLS is doing to provide help to some professors from UP Diliman. They want to produce a compilation of photocopied works of 27 different authors for a course. This compilation will be used by about 100 students for the coming semester. The professors also want the students who will photocopy the compilation to pay for the use of these copyrighted materials. The money that will be collected will be distributed among the authors. FILCOLS traces and communicates with the authors. It also serves as the bridge between the authors and the users: professors and students.


After the Q & A portion came a short talk about PASAP and the closing remarks.

Luisa Camagay, the president of PASAP, introduced PASAP to everyone. She invited those who are not yet members to join the association.

Dr. Isagani Cruz, the Chair of FILCOLS and treasurer of PASAP, gave the closing remarks. He emphasized the importance of being a member of an RRO like FILCOLS. He mentioned that FILCOLS will be able to help the publishers of academic and scholarly materials in running after those who pirate their products.

The meeting ended with a salusalo sponsored by Ateneo de Manila University Press.

Ang Berne Convention ay isang pandaigdigang kasunduan sa pagbibigay-proteksiyon ng mga likhang pampanitikan at sining. Ito ay pinaiiral sa 164 na bansa. Lumagda ang Pilipinas dito noong 1951.

Tatlong principles ang pundasyon nito. Una, ang principle of national treatment kung saan nakasaad na dapat ay pantay ang trato sa mga awtor mula sa mga kasaping bansa at sa awtor na mula sa sariling bansa. Ikalawa, ang principle of automatic protection kung saan ang akda o likha ay agad na may proteksiyon ng batas sa sandaling nailuwal na ito ng awtor. Ang automatic protection ay hindi dapat na nakasalalay pa sa formality o anumang mahabang proseso.

Ang ikatlo ay tinatawag na principle of the independence of protection kung saan nakasaad na ang proteksiyon sa akda o likha na ibinibigay ng mga kasaping bansa sa Berne Convention ay hindi nakasalalay sa pagbibigay-proteksiyon sa akda o likha ng pinagmulang bansa.

Halimbawa, isang libro mula sa Norway ang napadpad sa Pilipinas. Ang Norway ay isang bansa sa Scandinavia. Kasama sa obligasyon ng Pilipinas na respetuhin ang karapatan ng may akda saang bansa man siya nagmula.

Baliktarin naman natin. Ang librong “It’s a Mens World” ni Bebang Siy na mula sa Pilipinas halimbawa ay napadpad sa Norway. Ang librong ito ay protektado sa Pilipinas at pagdating nito sa Norway ay bibigyan din ito ng proteksiyon. Kaya ipagtatanggol ng batas ng Norway ang karapatan ni Bebang Siy kapag may nag-reproduce ng libro para gamitin ng mga mag-aaral na nais maintindihan ang Mens sa Pilipinas. Ibig sabihin, ayon sa batas, dapat ay may kumokolekta ng karampatang bayad mula sa mga paaralan para sa pagpa-photocopy ng libro ni Bebang Siy.

Kung sakaling magkainteres ang mga Fil-Am sa libro ni Bebang Siy at napadpad ang libro sa United States of America, bibigyan pa rin ng mga Kano ng proteksiyon ang libro. Dapat lang. Ito ay bilang respeto sa Berne Convention at bilang pagsunod naman sa batas, kokolekta rin ng karampatang bayad mula sa mga institusyon na magpapa-photocopy o mag-ii-scan ng bahagi ng libro.

Kaya lang, may isa pang isyu. Ang proteksiyon ng libro sa Pilipinas ay buong panahon na nabubuhay ang awtor at 50 taon mula sa kanyang pagpanaw. Pero sa America ay buong buhay ng awtor at 70 taon mula sa kanyang pagpanaw. Kaninong batas ang masusunod kung ang libro ay galing sa Pilipinas at nasa America ito?

Ayon sa principle of the independence of protection, ang libro mula sa ‘Pinas ay mawawalan ng proteksiyon kapag umabot na sa 50 taon mula sa pagpanaw ng awtor. Hindi puwedeng madagdagan ng 20 taon para maging kaparehas ng proteksiyon sa America.

Inaanyayahan ang mga awtor, publisher o tagapagmana ng copyright na sumali sa FILCOLS upang mabigyang-proteksiyon ang kanilang mga akda. Wala pong membership fee. Ang mahalaga ay mayroon kayong published works (para sa mga awtor) at nasa inyo ang kapangyarihang mag-manage ng copyright (kung tagapagmana naman kayo ng awtor). ANNOUNCING THE 2011 MANINGNING MICLAT TRILINGUAL POETRY COMPETITION

The Maningning Miclat Art Foundation is calling on young poets 28 years
old and younger to submit their entry to the 2011 Maningning Miclat
Trilingual Poetry Competition.

The Poetry Competition consists of 3 divisions - Filipino, English and
Chinese. An entry must consist of at least eight (8) but not more than
twelve (12) poems for English and Filipino divisions, and at least five
(5) but not more than eight (8) poems for the Chinese division. Authors
may join all the divisions but can submit only one (1) entry in every
division. All entries should be original in every language and not a
translation of another entry.

All entries should be submitted in four (4) copies, double spaced on
81/2 x 11 inches bond paper with one inch margin on all sides and with
ARIAL or TIMES NEW ROMAN size 12 font together with an electronic copy
(CD or USB) of the poems. Entry should be submitted with pen name only.
Real name and pen name should be submitted in a separate sealed envelop
together with a biodata, copy of birth certificate, 2” x 2” photo and a
notarized declaration of originality and authenticity of authorship of
the entry.

Entries must be addressed to the Maningning Miclat Art Foundation, Inc.
(MMAFI), 2ndFloor Mile Long Building, Amorsolo St., Legaspi Village,

The Maningning Award, handed out yearly since 2003, honors China-born
Maningning Miclat, a poet of 3 languages, a published essayist, a
prize-winning visual artist, and teacher/translator/interpreter. Her
book of poetry, “Voice from the Underworld” (Anvil Publishing, Inc.,
2000) is the first book of poetry in the world in Filipino, English and
Chinese languages written solely by one author. Some of her poems were
included in a book of top international women poets in Chinese published
in China. She passed on in September 2000.

The Maningning Miclat Art Foundation was formed in 2001 to carry on the
artist/ poet’s legacy, encourage creativity, and recognize, support and
award young outstanding poets and artists. Poetry competition in
Filipino, English and Chinese languages is held during odd numbered
years while Painting competition is held during even numbered years.

Maningning Miclat was co-author, if posthumously, of the book, Beyond
the Great Wall: A Family Journal, which won a 2006 National Book Award
for biography. The Manila Critics Circle citation reads: “From 1971 to
1986, the Miclat family lived in the People’s Republic of China and this
gathering of essays from Mario, Alma, Banaue and the late Maningning
Miclat flow together in a majestic yet personal recollection of a time
and place between times and places. Beyond the Great Wall signifies the
act of celebration through memory, and moving on through returning.”

Grand winners in the 3 divisions of the Poetry Competition will each
receive P28,000.00 together with a Julie Lluch sculpture trophy. The
grand winners and the 2nd and 3rd Prize will each receive special
hardbound edition of the books "Voice from the Underworld" (Maningning
C. Miclat, Anvil, 2000, 2002), "Beauty for Ashes: Remembering
Maningning" (edited by Mario Ignacio Miclat & Romulo Baquiran, Jr.,
Anvil, 2001) "Beyond the Great Wall" (Mario, Alma, Maningning & Banaue
Miclat, Anvil, 2006, 2007) and "Secrets of the Eighteen
Mansions" ( Mario I Miclat, Anvil, 2010). The latter was longlisted at
the 2009 Man Asian Literary Prize. Past grand winners of the Maningning
Poetry Awards are Naya Valdellon (English) and Joselito delos Reyes
(Filipino) in 2003, Allan Pastrana (English), Joseph de Luna Saguid
(Filipino)and Ye Cai-sheng (Chinese)in 2005, Raymond John de Borja
(English), Erica Clariz delos Reyes (Filipino) and Chen Si-yuan
(Chinese)in 2007, and Mikael de Lara Co (English), Kristian Cordero
(Filipino) and Chen Liang (Chinese) in 2009.

2011 MANINGNING MICLAT POETRY AWARDS

RULES OF THE CONTEST

1. The contest is open to all poets of all nationalities, age 28
and below.

2. There are three divisions in the awards:

a) Filipino b) English c) Chinese

3. An entry must consist of at least eight (8) but not more than
twelve (12) poems for the Filipino and English divisions, and at least
five (5) but not more than eight (8) for the Chinese division.

4. Authors may join all the divisions but can submit only one (1)
entry in every division.

5. All entries should be original in every language and not a
translation of another entry.

6. A work which has been awarded a prize in another contest is not
qualified for the awards.

7. Published or unpublished works may be entered in the contest. If
published, the date of publication should be within 2010-2011.

8. All entries should be submitted in four (4) copies, double spaced
on 8 ½ x 11 inches bond paper with one inch margin on all sides and the
page number typed consecutively, e.g., 1 of 10, 2 of 10, and so on,
together with an electronic copy (CD or USB) of the poems.

9. Font should be ARIAL or TIMES NEW ROMAN, and the font size should
be 12.

10. Entry should be submitted with pen name only and not real name.
Real name and pen name should be submitted in a separate sealed envelope
together with a biodata, copy of birth certificate, 2” x 2” photo and a
notarized declaration of originality and authenticity of authorship of
the entry.

11. Entries must be addressed to the Maningning Miclat Art Foundation,
Inc. (MMAFI) , 2/F, Mile long Building, Amorsolo St., Legaspi Village,
Makati City not later than April 15, 2011. Entries sent by mail or
courier should be postmarked/invoiced not later than April 8, 2011.

12. Entries submitted via e-mail should be an RTF (Rich Text Format)
or a Word Document file and should be sent as an attachment together
with the author’s biodata and copy of birth certificate and notarized
certification of originality or authenticity of authorship of entry. The
original copy of the notarized certification should then be sent to
MMAFI thru mail. Entries submitted via e-mail should be transmitted not
later than April 15, 2011.

13. Submitted copies of winning entries shall remain with and become
the property of MMAFI. Copyright of the works remains with the author
but the latter grants, assigns and transfers into MMAFI the right
without necessity of any payment other than the prize which may have
been awarded to publish any winning entry or selection or portion
thereof as it may at its discretion determine; to make the work
available for downloading on the Internet or other electronic medium;
and /or to allow students to make copies for research or in connection
with their school requirements.

14. Plagiarism is anathema to the contest and MMAFI has the right of
action against the author, if it may be later on discovered that said
person is not the creator or owner of the copyright to the winning work.
The Foundation shall not be liable to any court action if a third party
files a case against the winner who plagiarized the work of the said
third party.

15. There will only be one Grand Prize winner for each division and
the prize is PhP 28,000.00 and a Julie Lluch sculpture trophy per
winning entry. The grand winners and the 2nd and 3rd Prize for each
division will receive special hardbound edition of the books "Voice from
the Underworld" (Maningning C. Miclat, Anvil, 2000, 2001), "Beauty for
Ashes: Remembering Maningning" ( edited by Mario Ignacio Miclat & Romulo
Baquiran, Jr., Anvil, 2001 ),"Beyond the Great Wall" (Mario, Alma,
Maningning & Banaue Miclat, Anvil, 2006, 2007), and "Secrets of the
Eighteen Mansions" (Mario I. Miclat, Anvil, 2010).

16. The Board of Judges shall have the discretion not to award any
prize if in its judgment no meritorious entry had been submitted.

17. MMAFI has the sole right to designate the persons who shall
constitute the Board of Judges in each division of the contest. The
decision of the majority of the Board of Judges in all divisions shall
be final.

18. The names of the winners and the members of the Board of Judges
shall be announced on September 29, 2011.
